Limitation of Liability Policies

This Limitation of Liability Policy is incorporated into and governed by the Buzix, Inc. Agreement and Terms of Service. By using Buzix, Inc. services, maintaining an active account, submitting payment, renewing service, or accessing the Buzix customer portal, you agree to this policy, the Agreement and Terms of Service, and all other incorporated Buzix policies.
Limitation of Liability
Buzix, Inc. shall not be liable for any indirect, incidental, special, punitive, exemplary, consequential, or commercial damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, loss of bids, loss of customers, loss of goodwill, loss of data, email delay or non-delivery, business interruption, reputational harm, search engine ranking changes, third-party penalties, or other commercial damages or losses arising out of or related to the use of, inability to use, interruption of, suspension of, termination of, or performance of Buzix, Inc. services, regardless of whether Buzix, Inc. has been advised of the possibility of such damages.
No Guarantee of Uninterrupted Service
Customer acknowledges that Internet, hosting, email, DNS, control panel, database, security, software, and related services are subject to interruptions, delays, maintenance events, security events, abuse events, routing problems, hardware failures, software issues, third-party failures, upstream provider issues, domain registrar issues, DNS propagation, spam filtering, firewall blocks, customer-side configuration problems, and circumstances beyond the control of Buzix, Inc.
Buzix, Inc. does not warrant or guarantee uninterrupted, error-free, delay-free, or completely secure operation of any service. Buzix, Inc. does not guarantee continuous website availability, continuous email delivery, continuous control panel access, continuous DNS availability, or continuous access to any specific feature, server, system, application, or third-party service.
Customer-Side Responsibility
Customer is solely responsible for the configuration, maintenance, security, monitoring, and proper use of all local devices, computers, phones, tablets, mail applications, FTP applications, website software, scripts, passwords, routers, networks, and third-party software used to access or interact with services provided by Buzix, Inc.
Buzix, Inc. is not responsible for problems caused by customer-side devices, third-party software, email clients, outdated passwords, saved passwords, local device configuration, local malware, Internet providers, DNS providers, registrars, wireless carriers, routers, firewalls, printers, scanners, website plugins, scripts, themes, content management systems, or other systems not owned or directly controlled by Buzix, Inc.
Email Clients, Authentication Failures, and Firewall Blocks
Repeated failed POP3, IMAP, SMTP, webmail, cPanel, FTP, or other authentication attempts may trigger firewall blocks, login restrictions, mail restrictions, or other security actions. These security actions may occur automatically and are intended to protect Buzix, Inc. servers, customers, IP reputation, networks, and services.
Firewall blocks or access restrictions caused by customer-side mail clients, outdated passwords, misconfigured devices, repeated login failures, malware, scripts, or third-party software are not considered server outages. Buzix, Inc. may assist with identifying the likely cause as a courtesy, but the customer remains responsible for correcting the underlying customer-side problem.
Courtesy Support
Any technical assistance provided by Buzix, Inc. regarding third-party software, local device configuration, mail client configuration, DNS providers, registrars, customer scripts, customer websites, customer applications, or other systems outside Buzix, Inc.'s direct control is provided as a courtesy only.
Courtesy assistance does not create an obligation for Buzix, Inc. to provide ongoing support, repeated troubleshooting, local device support, business consulting, webmaster services, programming services, malware cleanup, customer-side repair, or third-party software support.
Security, Abuse, and Operational Restrictions
Buzix, Inc. reserves the right to suspend, deny, limit, block, disable, quarantine, restrict, or terminate services, access, mail activity, scripts, websites, databases, domains, accounts, control panel access, support access, or other resources at its discretion where customer actions, software, devices, passwords, configurations, scripts, mail clients, websites, or usage patterns create repeated operational, security, abuse, billing, reputation, resource, or support issues.
Buzix, Inc. may take emergency or protective action with or without prior notice when necessary to protect servers, other customers, networks, upstream providers, third parties, IP reputation, data, or Buzix, Inc. itself.
Suspension and Termination
Buzix, Inc. is not liable for damages, losses, claims, lost profits, lost revenue, lost bids, business interruption, missed email, website downtime, data loss, customer complaints, third-party claims, or other consequences arising from account suspension, service restriction, firewall block, security action, abuse enforcement, billing suspension, termination, or refusal to provide continued service.
Data, Backups, and Customer Content
Customer is responsible for maintaining independent backups of websites, email, databases, files, applications, configuration data, and other customer content. Any backup service or backup assistance provided by Buzix, Inc. is not a substitute for the customer's own independent backup practices unless a separate written agreement specifically states otherwise.
Buzix, Inc. is not liable for loss of data, corruption of data, incomplete backups, unavailable backups, deleted accounts, terminated services, compromised websites, customer error, software failure, third-party failure, or failure by the customer to maintain independent backups.
Third-Party Services
Buzix, Inc. is not responsible for failures, interruptions, billing issues, policy changes, restrictions, suspensions, or actions by third parties, including but not limited to domain registrars, DNS providers, payment processors, software vendors, control panel providers, SSL providers, spam filtering systems, blacklists, Internet providers, email providers, upstream providers, search engines, content delivery networks, and other external services.
Maximum Liability
In all cases, the maximum aggregate liability of Buzix, Inc. for any claim related to services shall not exceed the total amount actually paid by the customer to Buzix, Inc. for the affected service during the three (3) months immediately preceding the event giving rise to the claim.
If no amount was paid for the affected service during the three (3) months immediately preceding the event giving rise to the claim, Buzix, Inc.'s maximum liability shall be zero dollars.
Time Limit for Claims
Customer agrees that no claim, demand, dispute, lawsuit, arbitration, or other action arising out of or related to services provided by Buzix, Inc. may be brought more than one (1) year after the event giving rise to the claim occurred, unless a shorter period is required by applicable law.
No Expansion of Liability
No employee, contractor, representative, support response, ticket reply, courtesy assistance, troubleshooting step, account restoration, repeated unblock, temporary service restoration, or other action by Buzix, Inc. shall expand Buzix, Inc.'s liability beyond the limits stated in this policy and the Agreement and Terms of Service.
Policy Acceptance and Revisions
Buzix, Inc. may require customers to accept the current Agreement and Terms of Service, Limitation of Liability Policy, Billing Policy, Abuse Policy, Privacy Policy, Support Policy, or other incorporated policies before submitting support tickets, making payments, renewing services, accessing the customer portal, or continuing service.
Buzix, Inc. may track policy acceptance by customer ID, user ID, timestamp, IP address, policy version, or other reasonable records. Continued use of Buzix services after a policy update constitutes acceptance of the updated policy.
Governing Law and Venue
Disputes relating to this policy are governed by the Governing Law and Venue provisions of the Buzix, Inc. Agreement and Terms of Service.
